Terms of Service

1. Acceptance of these Terms

By downloading, installing, or using BillSpike ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms, together with our Privacy Policy, form the whole agreement between you and us about the Service.


2. What the Service Does

BillSpike is a mobile application that lets you:

  • Photograph or upload receipts and have AI read them, extracting the merchant, date, line items, prices, discounts, totals, tax and currency.
  • Organise receipts with tags, and search and filter your history.
  • Split a receipt between people you add, track each person's share, and record payments against it.
  • View spending statistics over a range of time periods.

The Service is provided on a subscription basis with a free tier and a paid tier. What each tier includes is set out in section 5 and shown in the app.


3. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract under the law of Scotland. By using the Service you confirm that you meet these requirements.


4. Your Account

  • You are responsible for keeping your account credentials secure.
  • You must provide accurate information when registering.
  • Tell us immediately at legal@billspike.app if you become aware of unauthorised use of your account.
  • We may suspend or terminate accounts where we have reasonable grounds to suspect a security compromise.

5. Subscriptions, Allowances and Billing

5.1 Tiers and scan allowances

The Service meters a monthly scan allowance — the number of receipts you can process in a billing month. A receipt rejected by our automatic check because the image is not a receipt does not count against your allowance.

Pro also gives priority processing. Current pricing is displayed in the app and on the Google Play store listing.

We may change these allowances. Where a change reduces what you receive on a paid tier, we will give you at least 30 days' notice, and you may cancel before it takes effect.

5.2 Billing

  • Paid subscriptions are billed in advance, monthly or annually, through Google Play.
  • Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date.
  • Prices may change with 30 days' notice. Continuing to use the Service after a price change takes effect constitutes acceptance.

5.3 Cancellation

You may cancel at any time via the in-app Manage subscription screen (which opens Google Play subscription settings) or directly in Google Play. Cancelling stops auto-renewal; you keep paid features until the end of the current billing period.

If you delete your BillSpike account while a Google Play subscription is still set to auto-renew, we instruct Google Play, via our subscription provider RevenueCat, to cancel auto-renewal as part of deletion. Deleting your account ends access immediately, even if time remains in a paid period. Account deletion does not by itself entitle you to a refund of unused time — see section 6.

On platforms where we cannot cancel on your behalf (for example the Apple App Store, when available), you must cancel in that store's subscription settings before account deletion can complete.

If you create a new BillSpike account before a cancelled-but-unexpired store subscription ends, you may regain Pro access for the remainder of that period using Restore purchases while signed into the same store account. Restoring purchases does not restore deleted receipts or any other account data.


6. Refunds and the Cooling-Off Period

6.1 Your 14-day right to cancel

If you are a consumer in the United Kingdom, you have the right to cancel a new subscription contract within 14 days of purchase under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, without giving a reason, and receive a refund.

Starting immediately reduces that refund. Before you subscribe, the app asks you to confirm that you want the Service to start straight away. When you subscribe you are making that express request, and you accept that your refund reduces in proportion to the service already delivered by the time you cancel. This is shown to you above the purchase button, and it is the only way we begin providing paid features before day 15.

To cancel within the 14 days, email legal@billspike.app.

6.2 After the cooling-off period

Once the 14 days have passed, subscription fees are non-refundable except:

  • Where required by law.
  • In exceptional circumstances, at our discretion.

6.3 Google Play's refund policy

Google Play's own refund policy applies in addition to, and independently of, these Terms. Google Play may issue refunds in circumstances not covered above. We cannot override Google Play's refund decisions.

6.4 Payment disputes

If you dispute a charge, please contact us at legal@billspike.app before initiating a chargeback. Unresolved disputes may be raised through Google Play's dispute process.


7. Acceptable Use

You must not use the Service to:

  • Upload content you do not have the right to share, including photographs containing other people's financial data without their consent.
  • Attempt to reverse-engineer, decompile, or circumvent any security measure.
  • Use automated means to access the Service at a rate exceeding normal human interaction.
  • Resell or sublicense access to the Service.
  • Engage in any unlawful activity.

We may suspend or terminate your account without notice if we reasonably believe you are in breach of this section.


8. AI Features and Accuracy

The Service uses AI to read receipt images. You acknowledge that:

  • AI-extracted data may be inaccurate, incomplete, or incorrectly formatted. Check extracted information before relying on it.
  • AI output is not financial, tax, legal or professional advice of any kind.
  • Receipt images are routed through third-party model providers via OpenRouter. See the Privacy Policy for what that means for your data.

9. Intellectual Property and Content

9.1 Ours

The Service — its software, design, and branding — is owned by us and protected by intellectual property law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own use, for as long as you comply with these Terms. You get no other rights.

9.2 Yours

You keep ownership of the receipt images and data you upload. You grant us a limited, non-exclusive, royalty-free licence to store, copy, transmit and process that content solely to provide the Service to you. That licence ends when you delete the content or your account, except where we must retain something under section 8 of the Privacy Policy.

We do not use your content to train AI models, and we do not use it for advertising.

9.3 Feedback

If you send us suggestions or feedback, we may use them freely, without obligation or payment to you. This does not give us any right to your receipt data.


10. Google Play

The Service is distributed through Google Play. Your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and has no responsibility for the Service or for supporting it.


11. Service Availability

  • The Service is provided on a reasonable-endeavours basis. We do not guarantee 100% uptime.
  • We may perform maintenance at any time, and will give reasonable advance notice of planned downtime where practicable.
  • We may discontinue the Service with 30 days' written notice. If we do, we will refund any unused prepaid subscription period on a pro-rata basis.

Force majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including the failure of a third-party provider we depend on, network or power failure, government action, or natural disaster. If such an event prevents us providing the Service for more than 30 days, either of us may end the agreement, and we will refund any unused prepaid period.


12. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability to you in connection with the Service will not exceed the subscription fees you paid in the 12 months immediately before the event giving rise to the claim.
  • We are not liable for indirect, incidental, special, consequential or punitive damages, including loss of data, loss of profits, or loss of goodwill.

Nothing in these Terms limits or excludes:

  • Liability for death or personal injury caused by our negligence.
  • Liability for fraud or fraudulent misrepresentation.
  • Your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 — that services be supplied with reasonable care and skill, within a reasonable time, and for a reasonable price where none was agreed.
  • Any other liability that cannot be excluded under the law of Scotland.

13. Termination

13.1 By you

You may delete your account at any time in the app, under Profile → Delete account, or by emailing legal@billspike.app.

Account deletion is permanent and irreversible. Your receipts, images, splits and profile are erased as described in section 8 of the Privacy Policy. Where a Google Play subscription is still set to auto-renew, deletion cancels that auto-renewal as described in section 5.3. Deleted data is not restored if you later create a new account, although a residual paid store period may attach to a new account via Restore purchases until it expires.

13.2 By us

We may suspend or terminate your account if:

  • You breach these Terms and fail to remedy the breach within 7 days of written notice, or immediately where the breach cannot be remedied.
  • You fail to pay subscription fees after a 7-day grace period following a failed payment.
  • We are required to do so by law.

On termination, your data is deleted in accordance with the Privacy Policy.


14. Changes to These Terms

We may update these Terms. Material changes will be notified by email to the address on your account at least 14 days before they take effect. Continuing to use the Service after the effective date constitutes acceptance. If you do not accept the updated Terms, cancel your subscription and delete your account before they take effect.


15. General

Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours to a company that acquires our business, provided your rights are not reduced; we will tell you if that happens.

Severability. If any provision of these Terms is held unenforceable, the rest remains in force, and the unenforceable provision applies to the maximum extent permitted.

No waiver. If we do not enforce a right immediately, we do not lose it.

Third parties. No one other than you and us has any right to enforce these Terms. No term of these Terms is intended to confer a right on any third party under the Contract (Third Party Rights) (Scotland) Act 2017 or otherwise.

Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service, replacing anything said or written beforehand. Nothing here limits liability for fraudulent misrepresentation.

Notices. We contact you by email at the address on your account. Contact us at legal@billspike.app, or by post at the address in section 17.


16. Governing Law and Disputes

These Terms are governed by the law of Scotland. Disputes are subject to the exclusive jurisdiction of the Scottish courts, except where consumer protection law gives you the right to bring proceedings elsewhere.

If you have a complaint, contact us first at legal@billspike.app. We aim to resolve complaints informally within 14 days. If we cannot, you may take the matter to court. We do not currently subscribe to an alternative dispute resolution scheme, and we are not required to.
